Surette Data Systems is a technology services company based in Southwest Florida. We provide website design, managed hosting, website care plans, custom business software, in-home tech support, and office network setup to clients in the Southwest Florida area and beyond.

Services Covered

These Terms apply to all of the following services offered by Surette Data Systems:

Website Design

We design and build custom, professional websites tailored to your brand. Deliverables and project scope are agreed upon before work begins and confirmed in a separate service agreement or proposal.

Managed Hosting

We provide website hosting that includes server management, uptime monitoring, automated backups, and security maintenance. Hosting is provided on a subscription basis and is subject to reasonable use.

Website Care Plans

Care plan subscribers receive ongoing website updates and support through a dedicated WhatsApp account that we set up specifically for your business. The scope of included updates is defined in your care plan tier. Requests outside that scope may be quoted separately.

Custom Business Software

We build and license SaaS (software-as-a-service) web applications and desktop installers under the Surette Data Systems app suite. Licensing terms specific to each product are detailed in Section 4 below.

In-Home Tech Services

We provide on-site technology support for residential customers in Southwest Florida. Services include device setup, Wi-Fi configuration, printer installation, smart home equipment, and home office organization. Appointments are scheduled in advance and are subject to availability.

Office Network Setup

We plan, install, and configure network infrastructure for small offices in Southwest Florida. This includes routers, switches, Wi-Fi access points, workstations, shared devices, and network cleanup. Scope is confirmed before work begins.

Accounts and Registration

Some of our services require you to create a client account. When you register, you agree to the following:

• You will provide accurate, current, and complete information.
• You will keep your account information up to date.
• You are responsible for keeping your password and login credentials secure.
• You will not share your account with others or allow unauthorized access.
• You will notify us promptly if you suspect unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in misuse, or remain unpaid. Account termination does not release you from any outstanding payment obligations.

Software Licensing and Access

SaaS Applications

Access to web-based software products in the Surette Data Systems app suite is provided on a subscription basis. Your subscription grants you a non-exclusive, non-transferable right to access and use the software for your internal business purposes during the subscription period. You may not resell, sublicense, or redistribute access to any SaaS product.

Desktop Installer Software

Desktop application installers are licensed per business entity. Your license permits installation and use by your business only. You may not redistribute, copy, reverse engineer, or resell the installer or its components. Each business must hold its own valid license.

License Restrictions

For all software products, you agree not to:

• Copy, modify, or create derivative works of the software.
• Decompile, disassemble, or reverse engineer the software.
• Use the software to build a competing product or service.
• Transfer or assign your license without our written consent.

Billing and Payment

Current pricing for our services is published on our website at surettesystems.com. Service-specific pricing pages include any applicable subscription terms, renewal cycles, and included features.

Full billing and payment processing terms will be published when our payment processing system activates. At that time, those terms will become part of these Terms of Service. We will notify active clients of any changes.

For services currently invoiced directly, payment terms are as stated in your invoice or service agreement. Overdue balances may result in suspension of services until payment is received.

Intellectual Property

Software Products

Surette Data Systems retains all intellectual property rights in its software products, including the Surette Data Systems app suite, source code, designs, databases, interfaces, and related documentation. Nothing in these Terms transfers any ownership rights to you. You receive only the limited license described in Section 4.

Website Design Deliverables

Upon full payment for a website design project, you own the final delivered design assets specific to your project — including your custom graphics, written content, and visual layouts as delivered. Surette Data Systems retains rights to the underlying code frameworks, templates, libraries, and development tools used to build your site. We may display your project in our portfolio unless you request otherwise in writing.

Your Content

Any content you provide to us — including text, images, logos, and brand materials — remains your property. You grant us a limited license to use it solely for the purpose of delivering your requested services.

Acceptable Use

When using any Surette Data Systems service, platform, or client portal, you agree not to:

• Use the service for any unlawful purpose or in violation of applicable law.
• Attempt to gain unauthorized access to our systems, servers, or other clients' accounts.
• Introduce malware, viruses, or harmful code into any of our systems.
• Misuse the client portal or support channels through abuse, harassment, or spam.
• Use our services to host, distribute, or transmit content that is illegal, defamatory, or infringes on a third party's rights.
• Circumvent or interfere with any security, authentication, or access control measures.

We reserve the right to investigate suspected violations and to suspend or terminate service without advance notice if we determine a violation has occurred or is reasonably suspected.

Disclaimers and Limitation of Liability

Services Provided "As Is"

Our services are provided for business and informational purposes. To the extent permitted by law, Surette Data Systems makes no warranties, express or implied, regarding the services, including any implied warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.

We do not guarantee that our services will be error-free, secure at all times, or available without interruption. We will make reasonable efforts to resolve any issues promptly.

Limitation of Liability

To the fullest extent permitted by applicable law, the total liability of Surette Data Systems arising from or related to your use of the services — whether based on contract, tort, negligence, strict liability, or otherwise — shall not exceed the total fees you paid to Surette Data Systems in the twelve (12) months immediately preceding the event giving rise to the claim.

No Indirect Damages

In no event shall Surette Data Systems be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or reputational harm, even if we have been advised of the possibility of such damages.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of the State of Florida. You consent to personal jurisdiction in those courts.

Before initiating formal legal proceedings, we encourage you to contact us directly at (239) 404-8505 to attempt to resolve the matter informally. We will make a good-faith effort to address your concern promptly.

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, operations, or legal requirements. When we make material changes, we will update the effective date at the top of this page.

Your continued use of any Surette Data Systems service after an update to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of the relevant service and contact us to discuss your options.

We recommend checking this page periodically if you are an active client.
