Surette Data Systems is a website design company based in Southwest Florida. We build one-time, custom websites for clients in the Southwest Florida area and beyond.

Services Covered

These Terms apply to all of the following services offered by Surette Data Systems:

Website Design

We design and build custom, professional websites tailored to your brand, paid for once and owned outright at handoff. Deliverables and project scope are agreed upon before work begins and confirmed in a separate service agreement or proposal.

Hosting & Domain Setup

As part of every website build, we deploy the finished site to your own hosting if you have it, or to a free base-tier Netlify account created in your own name if you don’t, and connect your domain with SSL verified. You are the account holder from launch and pay for domain registration and any hosting costs directly — Surette Data Systems does not sell hosting as an ongoing subscription.

Post-Launch Support

Every website build includes a limited post-launch bug-fix period. After that, further updates and changes are handled on request — through email, a support form, or a dedicated WhatsApp account we set up for your business — and billed at our published hourly rate. There is no subscription, retainer, or recurring fee for this support.

Billing and Payment

Current pricing for our services is published on our website at surettesystems.com. Website builds are one-time, non-recurring purchases — there are no subscription terms or renewal cycles. Service-specific pricing pages describe what is included with each package.

Full billing and payment processing terms will be published when our payment processing system activates. At that time, those terms will become part of these Terms of Service. We will notify active clients of any changes.

For services currently invoiced directly, payment terms are as stated in your invoice or service agreement. Overdue balances may result in suspension of services until payment is received.

Intellectual Property

Website Design Deliverables

Upon full payment for a website design project, you own the final delivered design assets specific to your project — including your custom graphics, written content, and visual layouts as delivered. Surette Data Systems retains rights to the underlying code frameworks, templates, libraries, and development tools used to build your site. We may display your project in our portfolio unless you request otherwise in writing.

Your Content

Any content you provide to us — including text, images, logos, and brand materials — remains your property. You grant us a limited license to use it solely for the purpose of delivering your requested services.

Acceptable Use

When using any Surette Data Systems service, you agree not to:

• Use the service for any unlawful purpose or in violation of applicable law.
• Attempt to gain unauthorized access to our systems or servers.
• Introduce malware, viruses, or harmful code into any of our systems.
• Misuse our support channels through abuse, harassment, or spam.
• Use our services to host, distribute, or transmit content that is illegal, defamatory, or infringes on a third party's rights.
• Circumvent or interfere with any security or access control measures.

We reserve the right to investigate suspected violations and to suspend or terminate service without advance notice if we determine a violation has occurred or is reasonably suspected.

Disclaimers and Limitation of Liability

Services Provided "As Is"

Our services are provided for business and informational purposes. To the extent permitted by law, Surette Data Systems makes no warranties, express or implied, regarding the services, including any implied warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.

We do not guarantee that our services will be error-free, secure at all times, or available without interruption. We will make reasonable efforts to resolve any issues promptly.

Limitation of Liability

To the fullest extent permitted by applicable law, the total liability of Surette Data Systems arising from or related to your use of the services — whether based on contract, tort, negligence, strict liability, or otherwise — shall not exceed the total fees you paid to Surette Data Systems in the twelve (12) months immediately preceding the event giving rise to the claim.

No Indirect Damages

In no event shall Surette Data Systems be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or reputational harm, even if we have been advised of the possibility of such damages.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of the State of Florida. You consent to personal jurisdiction in those courts.

Before initiating formal legal proceedings, we encourage you to contact us directly at (239) 404-8505 to attempt to resolve the matter informally. We will make a good-faith effort to address your concern promptly.

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, operations, or legal requirements. When we make material changes, we will update the effective date at the top of this page.

Your continued use of any Surette Data Systems service after an update to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of the relevant service and contact us to discuss your options.
